Dental negligence

Dental negligence arises when a person has suffered injury which has been caused by or materially contributed to by substandard treatment and care from a dental practitioner.

It may result in the patient experiencing a great deal of pain, which can be very distressing. Most dentists are highly skilled and careful when treating their patients. However, there are occasions where avoidable injury may arise as a result of negligent treatment.

Treatment may be provided by a private dental practitioner or an NHS dentist. If the alleged negligence happened following treatment at an NHS dental hospital, then the claim would be against that hospital Trust. If it arose under the care of a dentist in private practice then any claim would be directed against the dentist concerned and ultimately, their insurer.

As a result of the negligence, a person may have suffered avoidable pain, injury and suffering (physical and psychological) and there may also be financial loss due to further corrective treatment being required and lost earnings.

It is important to establish who has carried out the treatment or procedure, what was discussed before treatment went ahead and what was agreed or consented to. We can assist you with investigating any potential claim and help you to seek a claim for financial compensation.

    • How we can help you claim for dental negligence

It can take courage and can initially feel daunting approaching a medical negligence solicitor. This is particularly so when wishing to challenge the treatment and care provided by a highly qualified professional such as a dentist, who we hold in high regard and who we place our health and trust in.

It is important to appreciate that mistakes happen in any situation involving human beings, regardless of how well trained, skilled, experienced and caring they are. Where mistakes are made and harm is caused with regard to patient care there are consequences that may lead you to consider instructing a solicitor to bring legal action on your behalf.

You may not be considering financial compensation once dental negligence has arisen - you may want to make sure that nobody else experiences the same injury that you did. This is entirely understandable. As humans, we trust in the training and expertise of our healthcare professionals and don’t expect harm to be caused. Many patients want lessons to be learned to prevent further harm for others.

Pursuing a claim against a healthcare professional (public and private) does raise awareness. Pursuing a claim leads to investigation and scrutiny and consideration of existing policies and procedures and to further training. It also allows for a financial settlement to be awarded which places a patient in a better position than they may have otherwise been.
